The following are Frequently Asked Questions regarding our Privacy Policy.
What information is collected that might be required to be provided under legal compulsion or Court Order?
Sometimes police or the Courts require an ISP to produce client login times, client identity details or records of Internet usage. While this is rare, and access is strictly regulated under the Telecommunications Act, it does mean that we may be required to hand over such information on demand.
Do you keep records of what web sites I go to?
It's part of the way the web servers work, and diagnose faults, to keep these details on the system for a few hours. Our staff are under orders not to look at these records unless there is a technical problem. It is possible that police may obtain a warrant to track a suspected criminal's use of the Internet access, similar to a warrant to monitor a telephone call, in which case all usage of the Internet access will be recorded and supplied to police as the law demands.
Does you record Caller Line Identification so that the phone number I use to access the Internet is logged?
Yes, it's useful in cases of stolen passwords or clients ringing STD or out-of-zone numbers by mistake. If you don't want to display CLI, you can turn it off by dialing #31# before you call.
When do you have to give details to third parties under compulsion of law?
Since clients' details are private, this information is only provided if the police give a written authorisation under the Telecommunications Act, or if a plaintiff obtains a Court Order. These processes are followed when police are investigating illegal activity, or when a plaintiff needs to prove identity or usage of an account in cases such as copyright violations, defamation or fraud.
What client data do you have to keep for 5 years?
Industry codes require ISPs to keep account records and complaint details for 5 years, and tax laws require us to keep revenue details for that period.
Does the Freedom of Information Act apply to your records?
No, but we give our clients the same rights of access and correction, and anyone who can establish a legitimate need for the details can apply for a Court Order.
Will you tell me if someone has applied to obtain information about me, or has made a complaint against me?
Yes, unless it is a police investigation. It might be considered an illegal "tip-off" to tell someone that the police are investigating them.
What security measures do you use to protect my personal information against hackers?
We employ high standards of security, firewalls and anti-hacking measures. We don't publish details of the software and hardware we use as security measures, as this would encourage hackers to fine-tune attacks, and security is constantly upgraded.
